The Criminal Application No.2759 of 2023 is an Application filed in Criminal Revision Application (ST) No.7595 of 2023 for condonation of delay of 61 days in preferring the Criminal Revision Application. 2.
The Criminal Revision Application is preferred challenging the order of conviction passed by the Judicial Magistrate First Class, Jalgaon in S.C.C. No.1422 of 2012 which was subsequently confirmed by the learned Adhoc Additional Sessions Judge, Jalgaon in Criminal Appeal No.61 of 2016 by an order dated 14 February 2023.

Mr. Patwardhan, learned Advocate for the Applicant would submit that the Respondent has been duly served. In fact the appearance for the Respondent of Mr. Gavhad, learned Advocate has also been entered and he has appeared on the previous occasion.

With the assistance of learned Advocate for the Applicant I have perused the contents of the Application for condonation of delay. In my view, sufficient cause is made out in this regard and the satisfactory explanation is set out for condoning such delay. Accordingly the following order is passed:-

The Criminal Application No.2759 of 2023 is allowed in terms of prayer clause (B).
