The applicant has approached this Court seeking regular bail in connection with FIR dated 15.03.2025 bearing Crime No. 84 of 2025 registered with Virgaon Police Station, Taluka Vaijapur, District - Chhatrapati Sambhajinagar (Rural) for the offences punishable under sections 109, 326(g), 351(2), 351(3), 352, 324(4), 324(5), 103(1), 61, 49, 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2.

Heard learned counsel for the applicant and the learned APP. Perused the record made available.

Perused the complaint. It is alleged therein that on 15.03.2025 in the morning at 10.30 am, when some labours were working in the field of the complainat, her neighbour Sangita Hansraj Tambe i.e. present applicant refrained complainant from taking tractor

2 BA / 1469 / 2025 through her field. Thereafter, at about 1.45 pm the complainant noticed smell of petrol. Thereafter, accused - Ravindra Hansraj Tambe set their house on fire. When complainant shouted, her husband came out of their house. It is alleged that accused Ravindra, with intent to kill by using axe, gave axe blow on the head of husband and on face. Further, it is alleged that threatened to kill complainant as well and gave blow of axe on her head. During the scuffle, complainant sustained injury to both the wrist and was seriously injured. As such, she was admitted in hospital by her son and husband. 4.

Learned counsel for the applicant submits that applicant is behind the bars since 19.03.2025, she has not committed any offence. The incident is stated to have taken place at 1.40 pm, however, the applicant had already left the field at 11.00 am. Though the complaint mentions three eye witnesses to the incident, their statements have not been recorded. In the supplementary statement, the only allegation is that when accused Ravindra Hasnraj Tambe set her house on fire, present applicant was present with him. No specific role is attributed to present applicant. He, therefore, prayed to grant regular bail to the applicant by allowing the application.

Learned APP opposed the application, submitting that the act is serious one, same disentitles applicant to seek bail.

Perusal of the complaint reveals that only allegation against the present applicant is, she restrained the complainant from taking tractor through her field. A Specific role of placing the house on fire, is against Ravindra Hansraj Tambe, which appears to have been improvised in the supplementary statement, implicating the present applicant. No purpose would be served by keeping the applicant behind the bars.

In that view of the matter, applicant is entitled to be enlarged on bail.

Resultantly, following order is passed :-

ORDER

(I) Application is allowed.

(II) Applicant - be released on regular bail on furnishing P.R. bond of Rs. 50,000/- (Fifty Thousand Only) with one or two local solvent sureties in the like amount, in connection with Crime No. 84 of 2025 registered with Virgaon Police Station, Taluka Vaijapur, District - Chhatrapati Sambhajinagar (Rural) for the offences punishable under sections 109, 326(g), 351(2), 351(3), 352, 324(4), 324(5), 103(1), 61, 49, 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :- (a) The applicant shall attend each and every date of the Trial Court, unless exempted by the Trial Court on emergent consideration.

4 BA / 1469 / 2025 (b) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

(c) The applicant shall submit Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and two of the near relatives. [ SACHIN S. DESHMUKH ] JUDGE arp/
