1] Heard learned counsel for the applicants and the learned APP for the respondent-State.
2] The applicants are apprehending arrest in connection with Crime No.0148/2024, registered at Udgir City Police Station, Taluka Udgir, District Latur, for the offences punishable under Sections 420, 406, 409, 120-B r/w. 34 of the Indian Penal Code & Section 3 of the
Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.
3] This court by orders dated 12.11.2024 and 13.11.2024 granted interim protection to the respective applicants in respective applications.
4] In ABA/1352/2024, the learned counsel for the applicant submits that the applicant is appointed as Manager at a local branch at Chhatrapati Sambhajinagar and, in ABA/1606/2024, the learned counsel for the applicant submits that the applicant is the Manager at Jalna branch of the bank and that the present FIR relates to illegality committed in branch at Udgir. The head office of the bank is at Parli-Vaijnath. The learned counsel submit that the applicants have no role as to the deposits or withdrawal or sanction of the loans in Udgir branch thereto. The learned counsel relies upon the order passed by this court in the case of Venktesh Bapurao Kulkarni Vs. The State of Maharashtra, dated 03.02.2025, in ABA/9/2025, in favour of the Chief Executive Officer of the bank, who has been granted anticipatory bail. The learned counsel submits that the role of the applicants would not travel beyond the role of the Chief Executive Officer of the bank. 5] The learned APP submits that the applicants are appointed as Regional Manager for Chh. Sambhajinagar and
Branch Manager at Jalna, as such, there is no controversy regarding the same.
6] Considering this aspect of the matter and considering that the anticipatory bail is granted to the applicant - Venktesh Bapurao Kulkarni by order dated 03.02.2025 in ABA/9/2025, who is the Chief Executive Officer of the bank and that the present applicants prima facie would have no role in the offence, the protection granted earlier can be confirmed.
7] In view of the above, the interim protection granted by orders dated 12.11.2024 and 13.11.2024 qua the present applicants stands confirmed, on the following terms:
i] The applicants shall attend the police station as and when required by the Investigating Officer. ii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.
8] In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled.
9] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
10] The applications stand disposed of.
