IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD CIVIL APPLICATION NO.9973 OF 2014 IN SECOND APPEAL ST.NO.7911 OF 2014 (REJECTED CASE NO.1036 OF 2014) Rameshwar s/o Kashinath Jirwankar ..Applicant

Versus

Ramchandra s/o Tukaram Ingale ..Respondent Mr N.K.Tungar, Advocate for applicant CORAM : N.W. SAMBRE, J.

DATE : 30th January 2015 PER COURT 1.

The registration of the second appeal came to be refused, as the applicant/appellant has failed to remove the office objection. 2.

There is delay of 12 days in preferring the present application. 3.

The fact remains that in the second appeal, this Court has not taken cognizance. As such, in my opinion, no prejudice will be caused, if delay of 12 days is condoned.

4.

The delay, as such is condoned subject to payment of Rs.1,500/- to be paid to High Court Bar Association's Library within one week from today. The order passed by Registrar (Judicial) dated 20.8.2014 thereby refusing the registration of the second appeal is set aside. 5.

The applicant submits that he shall remove office objections within period of two weeks from today. Undertaking accepted. 6.

Civil Application stands disposed of in above terms. vvr ( N.W. SAMBRE, J.)
