Petitioner is seeking directions to respondents to process his pension proposal and release of pension amount, as he has been deprived of the same for more than eight years. Petitioner contends that he has taken voluntary retirement from service on 30.09.2017 from the post as Conductor with Maharashtra State Road Transport Corporation. He had by that time completed 35 years of service. He is, therefore, entitled to all the pensionary benefits.
923_WP_12196_2025 Learned Advocate Mr. N.K. Chaudhari suo motu appears for respondent No.2 and submits affidavit-in-reply by Mr. Rameshkumar Rambilas Yadav, Regional P.F. Commissioner-II in the office of RPFC-I, EPFO, Regional Office, Aurangabad. It is then stated in the affidavit that the information that was given by respondent No.3 in respect of PF Account No.NG/AUR/15841/4244 belong to one Shri. C.K. Kamble. Then there was a joint declaration by the employer and petitioner, thereby correcting the name of petitioner as Chandrakant Kisanrao Selukar. However, after the correction, the entire pension papers have not been forwarded to respondent No.2. According to learned Advocate for respondent No.
2, since petitioner had served in Thane Division, Parbhani Division and Beed Division, the papers, which are to be annexed with the proposal of petitioner, should be combined and even the undertaking has been given that if all the requisite documents are supplied, then within a period of three weeks from the receipt of said requisite documents and claim form, complete in all respect from respondent No.3, that would be cleared.
Learned Advocate Mr. D.S. Bagul appears for respondent Nos.3 to 5 and makes a statement that all the necessary documents and form would be supplied within one week to respondent No.2. The said statement on behalf of respondent Nos.3 to 5 is taken as undertaking. We also direct
923_WP_12196_2025 petitioner to co-operate with respondent Nos.3 to 5 and if his signatures are required, then petitioner should comply with the same, within the said period of one week and after respondent Nos.3 to 5 (especially respondent No.3) tenders all the documents to respondent No.2, then from the said date respondent No.2 would disburse the admissible monthly pension to petitioner as per the provisions of Employee Pension Scheme, 1995, within a period of three weeks.
With these directions, the writ petition stands disposed of. ( AJIT B. KADETHANKAR, J. ) ( SMT. VIBHA KANKANWADI, J. ) agd
