IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 1592 OF 2008 Adarsh Gruh Nirman Sahakari Society Chalisgaon Petitioner

Versus

Satish s/o Baburao Deshmukh & others Respondents Mr. R.M. Deshmukh, Advocate for the respondent no. 1. Mr. A.B. Chate, AGP for respondents no. 2 and 3. CORAM : M.S. KARNIK, J.

DATE : 16th August, 2019.

PER COURT :

1.

It is stated by learned counsel for the applicant that respondent no. 3 who is the original petitioner has filed a petition through the Chairman. After the death of the Chairman, there is no response and the petitioner does not seem to be interested in pursuing the petition as the order dated 31.03.2017 passed in Civil Application No. 2197/2017 would indicate. Even interim stay granted by this Court is vacated. Thereafter no steps have been taken by the petitioner or the liquidator to implead him as petitioner in the petition.

2.

In this view of the matter, the writ petition itself is dismissed for non-prosecution.

Consequently, Civil Application No.

{2} ca8751.19.odt 8751/2019 does not survive and stands dismissed for not prosecution.
