Respondent No.2 has passed away. Appeal stands abated to his extent.

This application suffers from delay of (90) days. Shri Munde, learned Advocate submits that the reasons for the delay are properly explained in this application. Delay is neither inordinate nor deliberate. 3.

Shri Babhulgaonkar, learned Advocate appearing on behalf of all the L.Rs. of deceased respondent No.2, opposes the application on the ground that the reasons cited are not satisfactory.

Taking into account the circumstances as noted above, this Civil Application is allowed. Delay stands condoned, subject to applicant's depositing costs of Rs. 500/-, on/or before 20.6.2015, with the Advocate Association's Bar Library, High Court, Bench at Aurangabad, as graciously submitted by the learned Advocate for the applicants. After depositing the costs, the L.Rs. of respondent No.2 be brought on record within two weeks therefrom.
