DATE : 15-12-2022 P.C. :- Learned advocate for the appellant submits that the appellant who is the wife of the respondent had preferred this appeal against the judgment and order passed by the Family Court on the basis of compromise. Issue regarding maintainability was raised. Learned advocate for the appellant on instructions and referring to the decision of the Supreme Court in the matter of Vipan Aggarwal & Anr. V/s. Raman Gandotra & Ors. in Special Leave to Appeal (Civil) No.20075/2021 seeks leave to withdraw the appeal with liberty to approach the Family Court wherein the compromise was entered in to since the appellant is alleging fraud. Appeal is dismissed as withdrawn with liberty as prayed for.
