Heard the learned counsel for the applicant, the learned A.P.P. for the respondent/State and the learned counsel for respondent No.2.

The applicant seeks bail in Crime No.0624 of 2023 registered with Tofkhana Police Station, Ahmednagar, for the offences punishable under Sections 354, 354A, 354B of the Indian Penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offencs (POCSO) Act, 2012.

The applicant is sixty-one years old. It has been alleged that he has outraged the modesty of a girl. He is languishing in jail since 22.04.2023. No weapon has been allegedly used in the crime. The investigation has been completed. Nothing is to be

903-BA-1316-23.odt recovered from the applicant. He has roots at Ahmednagar. He is a rickshaw driver. No purpose would be served by keeping him behind bar. However, the interest of the victim and the witnesses has to be guarded by certain conditions. Hence, the order:- i) The application is allowed.

ii) Applicant Abhay Nilkanth Satralkar be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not contact the victim or her relatives in any mode or manner till conclusion of the trial.

(c) He shall attend the trial on each effective date. (d) He shall not enter Narhari Nagar, Gulmohar Road, Ahmednagar, for two months from the date of his release.

iii) The Secretary, High Court Legal Services Sub-Committee, Aurangabad, do pay the fee to the learned counsel appointed for respondent No.2/victim as per the schedule.
