Looking to the age and period of conviction, the order dated 10/08/2015 passed by the Additional Sessions Judge, Shahada rejecting the application of bail of present applicant, is hereby set aside. The applicant will be entitled for release on the following terms and conditions.

The applicant be released on bail, on furnishing P.R. bond of Rs. 10,000/- (Rs. Ten thousand) with one surety in the like amount before the lower appellate Court.

4467.15crpln -2As the hearing before the Court below is already expedited, the applicant shall attend the lower appellate Court personally every fortnight. His two consecutive absence shall result in cancellation of his bail. He shall furnish undertaking before lower appellate Court that he shall co-operate and make himself available during course of hearing of the appeal. If any of the conditions referred to above are not complied with, the prosecution will be at liberty to apply for cancellation of the bail. 3.

The application is allowed in above terms.
