The learned counsel submits that the validation proceeding is pending since 10th February, 20218. The same is not yet decided. Now the petitioner is issued notice on 14th August, 2021 as to why the petitioner should not be disqualified.

As far as the show cause notice issued to the petitioner is concerned, this Court may not be in a position to come to the aid of the petitioner in view of the judgment of the Apex Court in the case of Anand Vs. Committee for Scrutiny and Verification of Tribe Claims, reported in, (2012) 1 SCC 113.

The Committee shall also consider that the application of the

940 wp.10482.21.odt petitioner for verification of the caste claim is pending since February 2018.

In case, the validation proceeding is pending with respondent No.2, then respondent No.2 shall decide the same expeditiously, preferably within four months from the date of appearance of the petitioner.

The petitioner shall appear before the Committee on 11th October, 2021.

The writ petition is disposed of. No costs.
