Heard learned counsel for the petitioners and the learned A.G.P. for the respondents/State in both the Contempt Petitions.

Learned A.G.P. states that thrice property was put to auction. Last time auction was held in February, 2016. The upset price as per the ready reckoner was 1.31 crores. No bidder was received for the said price.

Learned counsel, on instructions, further states that now the authority is intending to proceed ahead with the auction under Section 183 of the Maharashtra Revenue Code. The respondent shall place the property of respondent no.4 for auction once again. The same shall be done within six weeks.

If the said auction does not materialise, then the respondent may proceed ahead under Section 183 of the Maharashtra Revenue Code. Respondent then shall also take further course of action under the provisions of the Maharashtra Revenue Code in respect of revenue recovery certificates expeditiously.

With the above observations, Contempt Petitions disposed of. It is made clear that if steps are not adhered to, the petitioners would be at liberty to make grievance about non-adherence. No costs.
