Both the Civil Applications are preferred by the applicants to bring on record legal heirs of Bhujang Bajirao Kusale who is respondent no.1 in CA No.8739/2020 and sole respondent in CA No.8744/2020. The deceased Bhujang Kusale expired on 11.09.2020. In support of averments in the applications, death certificate of Bhujang Bajirao Kusale is filed on record. It is evident from the death certificate that Bhujang Bajirao Kusale expired on 11.09.2020. Both the Civil Applications are filed on 08.12.2020 and are within limitation. 2.

Considering above and by virtue of the provisions under Chapter II Rule 3 sub rule (i) of the Bombay High Court Appellate Side Rules, both the applications are allowed. The necessary amendment be carried out within stipulated period.
