Heard the parties for some time.

The present application is filed by the wife seeking transfer of matrimonial proceeding from the Court of learned C.J.S.D., Vadagon Maval to the Court of learned C.J.S.D., Bhoom. It is the case of the wife that, the distance between two places is more than 250 kms. There is already one proceeding under the provisions of Protection of Women from Domestic Violence Act initiated by the waife in the Court at Bhoom. The husband has already appeared in the said proceeding. By now, it is settled that
2 37-MCA 237-2024.odt the proceedings are to be transferred on a request of the wife at the place convenient to the wife. In the present case, the wife is residing with her parents. There is no one to accompany her to attend the Court at Vadgaon Maval. Thus, the learned advocate prays that, the proceeding be transferred to the Court at Bhoom. 3.
The application is vehemetnly opposed by learned advocate for respondent.

However, since the wife is residing at Bhoom, it would be in the interest of justice to transfer the proceeding to Bhoom. Hence, following order.
ORDER
(I) Misc. Civil Application is allowed in terms of prayer clause (C).
(II) After transfer of the proceeding, the applicant - wife shall not seek unnecessary adjournments. If unnecessary adjournments are sought, the Court may pass appropriate order compensating the respondent - husband if he personally remains present. (III) Whenever a request is made by the respondent - husband to
3 37-MCA 237-2024.odt allow him to appear through video conferencing, the same shall be considered liberally.
(IV) As far as possible, the dates be given looking to the dates given in other proceedings.
