The learned Counsel for the Respondent No.1-employee in both these matters tenders across the bar a communication from the petitioner-management dated 19.10.2015 by which the dispute between the management and the employee has been brought to an end. The conditions mentioned in the said communication dated 19.10.2015 are acceptable to the Respondent No.1-employee. 1 / 3

It is further submitted that he has responded to the said communication by his letter dated 21.10.2015 which is also tendered across the bar indicating that he is willing to report for duties and settle the matter in the light of the letter dated 19.10.2015.

Copy of the said communication dated 19.10.2015 and the response of the employee dated 21.10.2015 are taken on record and collectively marked as 'Exhibit X' for identification. 4.

Mr. Salunke, learned Counsel for the petitionermanagement submits that in the light of Exhibit X and the specific statement of the employee that he has accepted the terms and conditions set out in the communication dated 19.10.2015, the impugned judgments in these petitions can be set aside and these petitions can be disposed off in terms of Exhibit X. The learned Counsel for the Respondent No.1-employee is agreeable. 5.

In the light of the above, by recording the statement made on behalf of Respondent No.1-employee and in the light of Exhibit X, both these petitions are disposed off. 2 / 3

Needless to state, since the employee has been reinstated and is working, the management shall accordingly take steps for forwarding his salary bills and his proposal for approval. 7.

In the event of any grievance between the parties, they shall be at liberty to take recourse to available legal remedy. (RAVINDRA V. GHUGE, J.) 3 / 3
