We have heard Mr. Tope, learned counsel for the petitioner.

It appears from the affidavit that the order imposing penalty is also passed.

The learned A.G.P. submits that, the petitioner has remedy of an Appeal.

The petitioner may file an Appeal against the order of penalty as well as seizure of the vehicle. If the Appeal is filed, the Authority shall take decision upon the application of the petitioner for release of the vehicle within a period of 30 days. The respondents may consider the payment of royalty on its own merits.

Writ Petition is disposed of. No costs.
