Appeal No. 638 of 2020 1.

The appellant seeks to challenge the Judgment and order dated 28-10-2020, delivered by the learned Sessions Judge, Aurangabad, in Sessions Case No.31 of 2019, vide which, the appellant has been held guilty of committing an act punishable under Section 302 of the Indian Penal Code and has been awarded life imprisonment. 2.

We have heard the learned Advocate for the appellant and the learned Prosecutor. The appeal is 'Admitted'. The learned Prosecutor waives service of notice on admission.

We request the trial Court to prepare the appeal paper book in Sessions Case No. 31 of 2019, as expeditiously as possible and preferably on or before 31-08-2021. Thereafter, the appeal paper book and the original record & proceeding, shall be transmitted to this Court, as expeditiously as possible and preferably on or before 30-102021. Criminal Application No. 2280 of 2020 4.

We have heard the learned Advocate for the applicant on the application praying for suspension of the substantive sentence and Bail.

The learned Advocate submits on instructions from the applicant that the applicant desires to withdraw this application. 6.

In view of the above, this application stands dismissed, as withdrawn.
