The learned Counsel for the petitioner state that on an application being filed in Regular Civil Suit No.75/2020, the plaint itself has been rejected vide order dated 04/10/2021. In the wake of the aforesaid development, the present writ petition, wherein the order passed below Exh.5 and the order passed in appeal, have been assailed.

In the wake of the rejection of the plaint, the writ petition do not survive and is therefore, disposed of, as infructuous. Needless to state that the above order is passed only in the subsequent development, without touching the merits of the matter.
