Heard learned counsel for the applicants and learned APP for the State.

The applicants seek pre-arrest bail in Crime No.250 of 2024 registered with Karmad Police Station, District Aurangabad for the offence punishable under Sections 304-B, 498-A, 504, 506 r/w 34 of the Indian Penal Code.

The applicants are the mother-in-law and brother-in-law of the deceased. The marriage of the deceased was performed on 01.06.2023. General allegations of demand of dowry and golden ornaments have been levelled against the applicants. Perusal of the FIR reveals that the deceased has complaint against the family of the
911-aba-1364-2024.odt (2) applicants that they were forcing her to go for the agricultural work. She was insulted by her in-laws saying that she is useless. Post death allegations have been levelled against the applicants that she committed the suicide for non-fulfillment of the dowry demand. She committed the suicide in the house. Considering the general allegations and non-user of the deadly weapons, though the offence is registered for the serious crime, the Court is of the view that their custodial interrogation would serve no purpose. Hence, the applications deserve to be allowed. Hence, the following order :
O R D E R
(i) Both Anticipatory Bail Applications are allowed. (ii) In the event of arrest, Applicants, Latabai Ganpat Pathade in Anticipatory Bail Application No.1364 of 2024 and Prabhakar Ganpat Pathade in Anticipatory Bail Application No.1234 of 2024, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of the like amount in the above crime, on the conditions that ;
(a) The applicants should attend the police station as and when called on written notice by the investigation officer till filing the charge sheet.
