The petitioners intend to avail of the statutory remedy u/s 10(2) of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962. It is, therefore, prayed that this petition may be disposed off and the time spent by the petitioners in this Court, may be excluded for the purpose of limitation as the statutory appeal would be filed on or before 31.05.2022.

In matters wherein the petitioners have made similar requests, WP Nos.5924/2020 and 6732/2019, this Court has passed orders on khs/May 2022/9942

- 2 - 14.12.2021 and 16.02.2021.

In view of the above, the writ petition is disposed off with liberty to the petitioners to avail of a remedy under Section 10(2) of the Act of 1962.

The learned Advocates representing the respective respondents consent and we record that there shall be no objection as regards the maintainability of the proceedings post initiation of the same by this petitioner under Section 10(2).

The time spent by the petitioners before this Court from 21.07.2019 until a further period of one month i.e. 31.05.2022, shall be treated as being excluded for the purpose of limitation. ( S.G. DIGE, J. ) ( RAVINDRA V. GHUGE, J.) khs/May 2022/9942
