PER COURT :- The Superintendent, Jalgaon District Prison, Class-II Shri Petras Joseph Gaikwad is present in the Court in view of our order dated 6.1.2021.

We have perused paragraph Nos.5 and 6 of the Minutes of the High Power Committee dated 11.5.2020, pursuant to the report dated 10.5.2020 submitted by Shri Sunil Ramanand, Additional Director General of Police & Inspector General of Prisons and Correctional Services, Maharashtra. It is thus decided by the High Power Committee that, the under-trials, who are not excluded by the categories mentioned below paragraph No.5(i)(1 & 2) of the minutes dated 11.5.2020, would be at liberty to approach the Trial Court for seeking interim bail on the same terms as mentioned in the decision of the said committee

Considering the above, we find that the explanation tendered by the learned Prosecutor on instructions from Shri Gaikwad in support of his order dated 9.10.2020, is proper. The learned Senior Advocate, on instructions from Shri Kulkarni, who has gathered instructions from the appellant, submits that the appellant desires to withdraw this appeal with a request that the trial may be expedited.

In view of the above, this Criminal Appeal No.637/2020 is disposed off.

The Special Court is requested to expedite the Trial in Special Atrocity Case No.6/2019 so as to be concluded as expeditiously as possible and preferably on or before the 30th day of June, 2021. Criminal Writ petition No.77/2020 shall stand adjourned to 22nd February, 2021.

In the event the trial is not concluded by 30.6.2021 and the delay is not attributable to the conduct of the accused, the accused is at liberty to renew his request for regular bail before the Trial Court.
