In view of our order dated 27.08.2024 the report was received on 27.08.2024 itself stating that applicant No.1 and respondent No.2 were the only persons present, however, applicant Nos.2 to 4 were not present at all before the learned Registrar (Judicial), who was asked to record the verification. Thereafter, after about a year, this Court by order dated 21.07.2025 directed all the applicants to remain present before the learned Registrar (Judicial) on 30.07.2025. None of the parties were present on that day before the learned Registrar (Judicial) as per the report dated 30.07.2025. Once again learned Advocate for the applicant submits that since there was death in the family, the applicants could not remain present. Interesting point to be noted is that within the said period [1]
114-appln-3294-2024.odt of one year, at no point of time there was a request on behalf of the applicants for sending the matter for verification once again. Each time when the matter is sent for verification the applicants are coming with some excuse. Now, as a last chance, the parties are directed to remain present before the learned Registrar (Judicial) on 22.08.2025 at 4.00 p.m. Learned Registrar (Judicial) to record the verification and submit the report on or before 29.08.2025 and prior to that applicants should deposit cost of Rs.5,000/- with the High Court Legal Services Sub Committee Aurangabad on or before 22.08.2025. 2.
Place the matter for further consideration on 04.09.2025. 3.
In case of failure on the applicants to deposit the cost amount and/or to remain present before the learned Registrar (Judicial) on that date, the application would stand dismissed automatically without further reference to the Court.
