This is the second Application by the Claimants to withdraw the amount deposited by the Acquiring Body along with interest in this Court. 2.

On the earlier occasion by order dated 30/07/2018, the Applicants were permitted to withdraw 60% amount out of the amount deposited by the Acquiring Body. Attention of this Court is drawn to the order dated 26/09/2018, passed in Civil Application No.11884/2018, by which total 75% amount is allowed to be withdrawn by the Claimants, whose lands were acquired out of the same land acquisition proceedings. In this view of the matter, the following order is passed :

ORDER

[I] The Application is partly allowed.

[II] The Applicants are permitted to withdraw 15% of the balance amount lying with this Court along with interest accrued thereon, subject to furnishing Sovlent Surety / Security to the satisfaction of the learned Registrar (Judicial) of this Court.

933-CA-11005-2025.odt [III] Rest of the amount be deposited in the Fixed deposit in any Nationalized Bank till the Appeal is disposed of. [IV] Application stands disposed off accordingly.
