Heard learned Counsel for the petitioner. In this petition the grievance is raised in respect of non-compliance of the order of this Court dated 19 December 2018 passed in Writ Petition No.14173 of 2018. This Court, by the above order, directed respondent No.1 to decide the appeal, if already not decided, within stipulated period of six months from the date of that order and it was further observed by this Court that this exercise is to be undertaken in accordance with law and after following procedure.

It is the grievance of the petitioner that inspite of the stipulation of period, the respondent failed to decide the appeal and the appeal is still pending before the respondent for decision. 3.

As the copy of the contempt petition was served on the office of Addl. Government Pleader, the learned Addl. Government Pleader established contact with the office of the respondent, who is occupying the position of Minister of Urban Development of State of Maharashtra. In response, it is informed to the learned Addl. Government Pleader that due to certain procedural and technical difficulties the appeal could not be heard and now hearing of the appeal is scheduled on 5 September 2019. It is also informed by the learned Addl. Government Pleader that if the parties extend co-operation to the respondent Authority, the Authority would decide the appeal as expeditiously as possible. Accepting this statement of learned Addl.

Government Pleader made before this Court on instructions, we deem it appropriate to dispose off the contempt petition by allowing the petitioner to appear before the respondent on the scheduled date i.e.

(3) the decision.

With the above directions, the petition is disposed of. 5.

Authenticated copy be supplied to the Addl. Government Pleader.
