Heard learned counsel for the petitioner.

By way of present petition, the petitioner assails the order dated 13.01.2022 passed by the learned Industrial Court, Jalgaon in Complaint (ULP) No.03/2017, whereby the complaint filed by the respondent came to be allowed.

Having gone through the order passed by the Industrial Court, it reveals that the earlier matter was compromised in a mediation as the respondent has withdrawn its own order of deduction of 16 days wages for two days strike. When the matter was already settled in mediation, the authority of the petitioner are not supposed to issue the order dated 4/2-3/2017 and therefore, in view of the above, the learned Industrial Court allowed the complaint filed by the respondent.

Considering the observations made by the learned Industrial Court, I do not find any reason to interfere with the order passed by the learned Industrial Court under Article 227 of the Constitution of India.
