The petitioner is seeking direction to the second respondent to declare the final result of the selected candidates in respect of the recruitment for the post of Laboratory Assistants as per Advertisement dated 18 December 2018. Incidentally, the petitioner is also seeking direction for her appointment. 2.

We have heard learned counsel for the parties. 3.

The learned AGP has brought to our notice an order dated 8 June 2022 passed in Writ Petition No.6707/2021(Rohini Rajendra Lavte Vs. The Additional Commissioner, Tribal Development, Thane & Ors.), thereby, the petitioner therein, seeking similar relief in respect of post of Warden (Female) in Government Hospital, was relegated to take recourse to the remedy available before the Maharashtra Administrative Tribunal.

Upon hearing the learned counsel for the parties for some time, the learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition as the petitioner intends to approach the Maharashtra Administrative Tribunal in the matter. 5.

Without expressing any opinion about the merits of the matter, the petition is disposed of as withdrawn. 6.

If the petitioner elects to approach the Maharashtra Administrative Tribunal, the Tribunal may consider any application for condonation of delay in the context of section 14 of the Limitation Act, 1963 and the pendency of this petition from 16 September 2021.
