Heard the learned counsel for the applicant, the learned A.P.P. for respondent No.1 and the learned counsel for respondent No.2.

The applicant seeks bail in C.R.No.66 of 2024 registered with Police Station Wadodbazar, Taluka Phulambri, District Aurangabad, for the offences punishable under Sections 354 and 354D of the Indian Penal Code and Section 12 of the Protection of Children From Sexual Offences Act, 2012.

The victim was fourteen years old. She and the applicant were acquainted to each other when she was taking education at another village. It is a solitary incident of the applicant when he had been house of the victim. When they heard the sound of the gate, he jumped wall compound and fled away. It was the mother who entered home when the applicant fled way. The victim was frightened and narrated the allegations.

The application has been opposed mainly on the ground that there are antecedents to his discredit.

No injury has been caused to the victim. They were acquainted with each other. They are not residing in same place. No weapon is allegedly used in the crime. The applicant is languishing in jail for sufficient period. The trial may take its time. 6.
Considering the age and the allegations levelled against him, the Court is of view that he deserves bail. Hence, the order:-
ORDER
i) The application is allowed.
ii) Applicant - Aniket Ramrao Danke be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not contact the victim or her relatives in any mode or manner till the conclusion of the trial. (c) He should attend the trial on each and every date. ( S. G. MEHARE ) JUDGE rrd
