We have heard Mr. Dixit, the learned advocate for the petitioner, Mr. Deshpande, the learned A. S. G. and Mr. Lavekar, the learned counsel for the respondent No. 3. 2.

It is submitted that, work order is issued in favour of the respondent No. 3 on 27.07.2018 and the period of tender was of one year only. Hardly three months have remained.

In view of that, it would not be possible to entertain the writ petition on merits. According to the petitioner rejection of technical bid was on erroneous ground. Certificate produced by the petitioner was satisfying the conditions of bid. As we are not considering the matter on merits, we are not considering the same. The writ petition is disposed of. No costs. 4.

Needless to state the petitioner is entitled to take up the proceedings as may be permissible in law.
