Present application is under Order I Rule 10 of the Code of Civil Procedure.

The respondent nos. 4 to 7 are the legal heirs of Audumbar Rangnathrao Kotalwar, the claimant. The applicant's father Vidyasagar had filed Regular Civil Suit No. 182/2021 against Bhaskar Rangnath Kotalwar and others. Present respondent nos. 4 to 6 were also parties to the suit, which was compromised on 01.08.2021 and the suit was disposed of by a consent decree. It was agreed that present applicant shall be impleaded in the present appeal and he would represent respondent nos. 4 to 6 and they be deleted.

The learned counsel Mr. Rodge confirms the settlement and has no objection for allowing the application.

The Civil Application is allowed in terms of prayer clause 'B' and 'C' 1/2

20 CA 9696 OF 2024.odt with clarification that respondent No. 7 Vanmala Sambhaji Kendre shall be a private party in the first appeal. Both parties shall be at liberty to carryout the amendment.
