The petitioner has already filed second appeal along with the application for condonation of delay.

In view of that, we are not inclined to consider the prayer Clause (C). 3.

The petitioner has filed appeal after the delay of five years in April, 2019 and has approached this Court seeking directions to decide the second appeal within a stipulated period.

At the first instance, the petitioner himself is responsible for the delay. The authority where the second appeal along with application for condonation of delay is pending, naturally, will decide the application for condonation of delay and if required the second appeal on its own merits, in

2 5-WP10804-19.doc accordance with law. The petitioner shall co-operate in the expeditious disposal of the same. The authority shall endeavor to decide the same expeditiously.

Writ Petition is disposed of. No costs.
