The first appeal is filed with a delay of 16 days. The learned counsel for the applicant submits that the delay is on account of medical grounds. The applicants has undergone a surgery. For the reasons stated, the delay of 16 days is condoned. The civil application of condonation of delay is allowed and disposed of.

The learned counsel for the applicant only impugns clause 4 of the order passed by the

2 ca 10110.2023+ Commissioner for E.C. Act and Judge, Labour Court, Latur in Application (WCA) No.184 of 2019, wherein he has directed to pay an amount of Rs.2,84,340/- along with simple interest at 12% per annum. The learned counsel submits he has deposited the entire amount in clause 4 before the Commissioner for E.C. Act and Judge, Labour Court, Latur.

In view of the deposit of the amount, clause 4 of the impugned order would remain stayed to the extent of the applicant. The civil application for stay stands disposed of.

Issue notice in first appeal to the respondents, returnable on 18.10.2023.
