The applicant prays for condonation of delay and setting aside abatement and in bringing heirs of deceased claimant Sundar Rangnath Pawar on record.

For the reasons stated in the application, it is desirable to condone the delay. The cause of action survives against the heirs of deceased claimant. The Civil Application is allowed in terms of prayer clause 'B', 'C' and 'D'. 3.

Both parties shall be at liberty to carry out the amendment within four weeks.
