BENCH AT AURANGABAD 3 WRIT PETITION NO. 9818 OF 2017 VISHAL RAJARAM ADAPAWAD MINOR THROUGH GUARDIAN FATHERRAJARAM GANPATI ADAPAWAD

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Yenegure Apparao AGP for Respondents: Mr. P.S. Patil ...

CORAM : S.C. DHARMADHIKARI & MANGESH S. PATIL, JJ.

DATE :

31.07.2017 P.C. :- .

The petitioner's request has not been considered and, therefore, this petition.

2.

We called upon Shri Patil, learned A.G.P. in the morning session to take instructions and inform as to why the second respondent Competent Authority has still not issued the tribe certificate. The application of the petitioner is pending with him since 06.04.2017. 4.

However, the Sub Divisional Officer says that he received it on 05.06.2017 and not earlier. Then, the Competent Authority says, on instructions, that he called upon the petitioner to produce the certificate/tribe certificate issued to the father. It is stated that the

( 2 ) p3 wp 9818.17 original of the same is not available. The Sub Divisional Officer says even a certified true copy thereof could have been produced. 5.

We do not see any reason for keeping an application received on 05.06.2017 pending and in this manner. We, therefore, direct that on the petitioner producing an affidavit of his father and a certified true copy of the tribe certificate issued to the father, the pending application shall be decided within a period of four days from the date, the petitioner's father produces the above documents. The writ petition is disposed of. 6.

The petitioner may be considered for admission to the Government Industrial Training Institute, Nanded on an undertaking to be given by him to the Competent Authority. As soon as the tribe certificate is issued and duly received, he will produce it before the Educational Institution. On such an undertaking furnished in writing, the petitioner be admitted, if he is otherwise eligible. [MANGESH S. PATIL, J.] [S.C. DHARMADHIKARI, J.] mub
