We have considered the submissions of Shri B.S. Shinde, the learned advocate for the petitioner, Mr. A.D. Aghav, the learned advocate for respondent Nos. 4 and 5 and the learned AGP on behalf of respondent Nos. 1 to 3.

The only issue before us is that, the petitioner is a tribal and belongs to the local tribal area. He is willing to work in PESA area and is not being deployed by the Zilla Parishad. 3.

The learned counsel for Zilla Parishad submits that if the petitioner makes an application online for posting in PESA area, his case will be considered. The petitioner is agreeable. 4.

In view of the above, this petition is disposed off. Let the petitioner make an online application, preferably within 10 days from

WP 9823/22 today. The Zilla Parishad shall consider the candidature of the petitioner as a local tribal to be deployed in the local tribal area, which falls in the category of PESA area. Let such decision be taken while dealing with the online application as per the procedure that is presently being followed and preference be given to the petitioner, on the ground that he is a tribal from the local tribal area.
