Present application has been filed by the original claimants for getting the delay of 111 days condoned in filing first appeal. They want to challenge the part of the judgment and award passed by the railway tribunal.

Learned Advocate appearing for the respondent strongly objects to the application on the ground that the delay has not been properly explained.

Taking into consideration the fact that the applicant No.1 is housewife, applicant Nos.2 to 4 are minors and for the reasons stated in paragraph Nos.2 to 5, the delay stands condoned.
