The petitioners are aggrieved by an order passed by the learned J.M.F.C. dated 10.04.2025 thereby issuing non bailable warrant in the proceedings in R.C.C. No. 66/2024 pending in the Court of learned J.M.F.C., Dharashiv. It is argued that, the learned Court without issuing summons and bailable warrant directly issued the non bailable warrant. It is further submitted that, the petitioners who are shown to be accused are residents of different places and still they are required to personally remain present in view of warrant issued by the learned Court.

This Court finds that, once the warrant is issued, it is for the petitioners to first approach the said Court and to pray for cancellation of warrant. Instead of availing that remedy, the petitioners have directly come to this Court. Only justification given is that the petitioners are residing at different places and they are required to personally remain present before the Court and therefore, the petitioners have approached this Court directly. This Court does not find any exceptional case made out to approach this Court directly. It is open for the petitioners to approach the said Court for cancellation of non bailable warrant. 3.
