The record would reveal that while the learned Judicial Magistrate First Class, Sangamner has convicted the present respondent for the offences punishable under section 279 and 304-A of the Indian Penal Code and section 184 of the Motor Vehicle Act vide judgment and order dated 27/07/2006 passed in Summary Criminal Case no. 957 of 2000, the learned Additional Sessions Judge, Sangamner has acquitted the present respondent vide judgment and order dated 6/4/2013 passed in criminal appeal no. 6 of 2006.

Upon going through the record, without making any comment on the same, it is found that arguable case is made out. Leave to file appeal is hereby granted. Criminal Application no. 4630 of 2013 accordingly stands disposed of.

Appeal be registered as per due course of law. The appeal stands admitted upon its registration. 5.
Action under section 390 of the Code of Criminal Procedure to follow. Respondent / accused shall appear before the concerned Judicial Magistrate First Class on or before 2nd May, 2015, who shall admit him to bail upon execution of P.R. bond in the amount of Rs.10,000/- (Rs. Ten Thousand) and surety in the like amount.
