The application of the petitioner for renewal of auto-rickshaw permit is not entertained on the ground that the same is filed after lapse of 180 days.

We have heard learned counsel for the petitioner and learned A.G.P.

Section 81(3) of the Motor Vehicles
Act, permits application to be accepted even after the last date of filing application for renewal if sufficient cause is shown. This Court under its order dated 31.8.2015 in W.P.No.6644/2015 had considered the said aspect and had observed that the application could have been entertained even after lapse of 180 days. Learned counsel for the petitioner submits that the petitioner is ready to pay delayed charges. 4.
In light of the above, the Respondents shall consider the application of the petitioner for renewal of the registration of the writ autorickshaw bearing No.MH-20-944B/2014 on its own merits considering Section 81 of the Motor Vehicles Act and the Rules framed thereunder. The same shall be decided expeditiously, preferably within three (3) months.

The Writ Petition is disposed of. No costs.
