The petitioner had already applied on 16th May 2019 for permitting him to undergo Ph.D. course as an in-service candidate. The stand of the respondent was that at the time the application was received by the University, the petitioner was under suspension. Though the petitioner is acquitted in the criminal case, the appeal is pending.

As far as the process before the I.C.R. Delhi is concerned, the same is completed. It is the contention of the petitioner that one post at Jabalpur is still vacant. The learned Counsel for the petitioner submits that the petitioner has also applied pursuant to the P.G. admission notification issued by the Karnataka Veterinary, Animal & Fisheries Sciences University, Nandinagar, Bidar. The application is to be submitted by 30th September 2019 through proper channel. The petitioner has already submitted application as required before the authority.

Learned Counsel for the petitioner submits that the petitioner is now not under suspension and acquitted in the criminal case. In the appeal pending, no further orders are passed. 4.

In view of that, the respondents shall consider the application of the petitioner filed on 16th May 2019 to prosecute the P.G. course as an in-service candidate, either with the Nanaji Deshmukh Veterinary Science University, Jabalpur and/or with Karnataka Veterinary, Animal & Fisheries Sciences University, Nandinagar, Bidar. The decision shall be taken on or before 30th August 2019. The university shall consider all the relevant aspects. The decision shall be communicated to the petitioner immediately.

Writ Petition disposed of. No costs.

Authenticated copy of this order be provided to the learned Counsel for the petitioner.
