It is submitted that the University has already submitted the proposal to the Joint Director of Higher Education for giving the benefit of Career Advancement in senior scale and selection scale to the petitioners. However, the Joint Director of Higher Education is not taking any decision. According to the learned counsel, the appointments of all these petitioners are prior to 23.10.1992. 3.
Those persons who have been appointed regularly prior to 23.10.1992 are entitled for Career Advancement Scheme benefit
even if they have not passed NET/SET as has been held by the Division Bench of this Court at its Principal seat at Bombay in Writ Petition No.2082/2013 with connected Writ Petitions under judgment and order dated 23.12.2015.

The proposal is already forwarded by the University to the Joint Director of Higher Education on 8.2.2016 (Exh.P-2 page 181). The Joint Director of Higher Education, shall take decision upon the same expeditiously in accordance with law and on its own merits within four (4) months.

The petitioners are at liberty to appear before the Joint Director of Higher Education, Aurangabad Region, Aurangabad and may place on record the documents if they so desire. The petitioners may appear before the Joint Director of Higher Education, Aurangabad Region, Aurangabad on 28.11.2016. 6.
The Writ Petition is disposed of. No costs.
