Present is an application seeking withdrawal of the amount deposited by the acquiring body in compliance with the award passed in L.A.R. No.786 of 2010.

Learned counsel for the applicants submitted that in-fact, the acquiring body was expected to deposit the entire amount under the award in view of the conditional stay order passed arp/

BENCH AT AURANGABAD by this Court, however, the acquiring body has deposited only 50% of the said amount and the learned counsel has therefore prayed for withdrawal of the entire said amount.

Learned counsel appearing for the acquiring body does not have any objection for permitting such withdrawal. Hence, the following order :- 5.

The applicants are permitted to withdraw the amount deposited by the acquiring body in this Court on submitting an undertaking that in the event any adverse order is passed, they will re-deposit the amount so withdrawn by them, if so ordered by the Court, within four (4) months of passing of such order.

Civil Application stands disposed of.
