Date: 22.1.2021 PER COURT :- We have heard the learned advocate for the petitioners and the learned AGPs appearing on behalf of the validity committee.
{2} The grievance of the petitioners is that, pursuant to the orders of this Court dated 29.7.2019 delivered in Writ Petition No.9224, 9250 and 9278 of 2019, Writ Petition No.9278 of 2019 and dated 24.2.2020 in Writ Petition No.3113 of 2020, the competent committee was directed to decide the validity claims of the petitioners within three months. It is submitted that in all these matters, the validity claims of these petitioners are now closed for Judgment on 21.1.2020 and no Judgment is forthcoming. A solemn statement is made, on instructions from the petitioners that, the committee which has conducted the proceedings while closing them for orders, continues to maintain the same constitution and there is no change in the constitution of the committee.
The learned AGP submits that if the committee is the same which has reserved the matters for orders, the claims of these petitioners would be decided on or before 20.2.2021. In the event, the constitution of the committee has changed in case of any of the petitioners, a fresh hearing is necessary and the petitioners would be accordingly appraised of the date of hearing which would not be latter than three weeks from today and their claims, thereafter would be decided within four weeks from the date of hearing.
In view of the above, all these Contempt Petitions are
{3} disposed off recording the submissions of the learned AGP as under:- (A) If the committee which has closed matters of these petitioners for passing orders, continues to have the same constitution, the claims of these petitioners would be decided on or before 20.2.2021 and the Judgment in these matters should be kept ready to be delivered to the parties, by following the due procedure.
(B) In the event of the constitution of any committee, in relation to any of these matters, undergoes any change, on account of retirement or transfer of any of the members of the committee etc.,, the concerned petitioners would be intimated by the new committee to appear before it on 20.2.2021 at 12 noon for further hearing and the hearing would be concluded latest by 22.2.2021. In these cases, the committee shall deliver its Judgment on or before 31.3.2021.
