DATED : 16th January, 2017 O R D E R :- Shri Temkar, learned counsel for the petitioner submits that the petitioner is original plaintiff and has filed the suit for partition and separate possession of the various joint family properties. The name of the Bank appears in the other rights column. It appears that some loan is obtained from the Bank. As such, the Bank is sought to be added as party.

No relief is claimed against the Bank.

The relief is with regard to the partition and separate possession. If required, the parties can examine the Bank/its Officers as its witnesses. As no relief is claimed, the Bank would not be necessary party. The Trial Court has rightly considered the same.

Writ Petition is accordingly dismissed.

No costs.
