The learned Assistant Government Pleader for respondents/state raises a preliminary objection that, the petitioner has alternate remedy available before the Maharashtra Administrative Tribunal.

In the light of that, though Mr. Deshmukh, the learned counsel for the petitioner sought to canvass submissions on merits of the matter, we are not inclined to consider the same. 3.

The writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions are kept open. No costs.
