Applicant apprehends arrest in Crime No.0167/2022 registered with Washi Police Station, Osmanabad for offences punishable under Sections 307, 354, 324, 323, 504 and 506 of the Indian Penal Code.

Heard learned advocate for applicant and learned Additional Public Prosecutor for respondent - State, perused the investigation papers.

In the FIR it is alleged that applicant has thrown chili powder in the eyes of informant and abused her. Husband of the applicant is alleged to have assaulted informant with sickle. 4.

Applicant has lodged FIR which is registered at Washi Police Station, Osmanabad bearing C.R. No. 166/2022 for offences

2 916-ABA-1186-22.odt punishable under Sections 307, 147, 148, 149, 324, 341, 504 and 506 of IPC, against informant and her family members. Applicant is injured in the said incident.

Perusal of investigation papers of crime in question shows that vague and general allegations are leveled against applicant.

Taking into consideration the role attributed to applicant, custodial interrogation of applicant is not necessary. Since the applicant herself was injured in the incident in question, applicant deserves protection. Application is, therefore, allowed in terms of interim order passed by this Court on 12/09/2022. Till filing of charge-sheet, applicant shall attend the concerned police station as and when called by investigating officer. (NITIN B. SURYAWANSHI, J.) SVH
