On the last occasion, the Court had expressed disinclination to grant the bail; however, learned counsel for the applicant insisted to call for the health report of the accused from the prison. He had tried his level best to convince the Court that due to the ill-health, the applicant may be entitled to the bail. However, the medical report submitted by the prison did not support his contention that the accused had such a decease that cannot be attended by the prison department.

Learned counsel, on instructions, seeks leave to withdraw the application. Leave granted. The application stands dismissed as withdrawn.
