This Court by order dated 29.08.2023 had adjourned the petition for taking instructions. Today the learned Advocate submits that he has no instructions to withdraw the writ petition. 02.

In the present writ petition, an order passed by the learned Director of Marketing dated 13.06.2024 is under challenge, whereby he refused to grant injunction. During the course of arguments, it is pointed out that the present petitioner has already approached the Civil Court by filing substantive suit. In the said suit, application below Exh.5 filed by the present petitioner came to be rejected and thus injunction is not granted against said order.

( 2 ) wp8981.24 Now Misc. Civil Appeal is also pending before the learned District Judge, Nanded.

In view of the above fact, this Court is not inclined to interfere with the present matter, as substantive proceeding is filed by the petitioner, which is pending. Therefore, the writ petition stands dismissed.

It is open for the petitioner to pursue the remedy available under law. This Court has not observed anything on the merits of the matter and the lower Court shall not be influenced by the order passed by this Court.
