In the present matter, delay caused in filing the appeal has been condoned by this Court today itself. The matter is covered by the judgment delivered by this Court in First Appeal No.993 of 2011, with consent of the parties the appeal is taken up for final disposal.

The learned counsel for the appellant tendered across the bar the copy of the judgment and order passed by this Court (Coram: V.K. Jadhav, J.) on 26.04.2017 in First Appeal No.993 of 2011. The aforesaid appeal was arising out the same acquisition proceedings from which the present appeal is arisen. The aforesaid first appeal has been dismissed by this court with the connected appeals.

Since, the present appeal is arising out of the same acquisition proceedings, for the reasons stated in the aforesaid judgment in First Appeal No.993 of 2011, the present appeal also deserves to be dismissed and is accordingly dismissed however, without any order as to costs.
