This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 42 of 2022 registered with Savda Police Station, Dist. Jalgaon for the offence punishable under Section 307 of the Indian Penal Code. 2.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The F.I.R. has been given by the victim himself. It is alleged therein that the applicant assaulted on the head of the informant with a sickle. The injury certificate dated 17th March, 2022 suggests the informant 1 / 2

934-BA-1417-22.odt to have suffered simple injury. The applicant is in jail for little over six months. On investigation, the charge-sheet has been filed. It will take time for commencement and conclusion of trial.

In view of above, the application deserves to be allowed. Hence I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released on bail, in connection with Crime No. 42 of 2022 registered with Savda Police Station, Dist. Jalgaon for the offence punishable under Section 307 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount.

(III) The applicant shall not enter village Rozoda, Tq. Raver, Dist. Jalgaon for next one and half year.

(IV) The applicant shall not tamper with the prosecution evidence.
