PER COURT :- 1) Heard. This court, while dealing with the challenge raised by the petitioner to the order dated 5.5.1988 passed by District Magistrate, Dhule, has not touched the issue of entitlement of petitioner to receive the pensionary benefits. It is not a matter of dispute that the petitioner stood retired from service on attaining the age of superannuation. It would be open for the petitioner to independently raise his claim for monetary benefits. The request made by the petitioner, seeking modification of the order passed by us on 22.11.2006, need not be considered, keeping open the option of the petitioner to agitate is claim for grant of pensionary benefits, Civil Application stands disposed of.
